NAUGHTY ICELAND



In the 1970s Iceland and Britain went to 'war' over cod fishing. The skirmishes between Icelandic trawlers and Royal Navy vessels were known as the Cod Wars.

Now there is another battle looming between Iceland and Britain, soon after England’s infamous defeat to Iceland in the Euro 2016 football tournament.

The Icelandic government is threatening to take legal action against Iceland Foods Ltd which runs a chain of supermarket stores selling frozen food. The stores trade under the name Iceland. The Icelandic government wants Iceland Foods Ltd to stop trading using the name of its country.

The first Iceland store was opened in Shropshire, my home county, in 1969. The founder of Iceland, Malcolm Walker, named his first store Iceland because he was a family friend of a former Icelandic Prime Minister.

The number of Iceland stores has gradually expanded in Britain and abroad. There are even three Iceland stores in Iceland!

In 1985, the Icelandic company, Baugur Group, bought the Iceland stores and, when the company went bankrupt in 2009, two Icelandic banks, Landsbanki and Glitnir, took over ownership of the stores until they were taken over by a management buy-out led by the founder, Malcolm Walker, in 2012!

Iceland Foods Ltd holds a Europe-wide trademark for the word 'Iceland', thus preventing Icelandic companies from trading under the name of their country!

I’ve always had major reservations of names and phrases being legally owned - I think language should be free to use by whomever, whenever and however.

Why should McDonald’s have legal copyright of the phrase 'I'm Lovin' It'? Why should the International Olympic Committee have forced London’s 'greasy-spoon' cafe, Café Olympic, to change its name during the London Olympics?

In the wake of Iceland threatened lawsuit against Iceland, the Turkish government is considering its legal options regarding the American tradition of eating roast turkey on Thanksgiving, the Chinese government is considering legal action against companies selling porcelain china, and the Chilean government is thinking of prosecuting chilli pepper farmers!

I’ve been told that the United States of America and the United Kingdom, with the support of the United Nations, are discussing taking three football clubs to court, Manchester United, Leeds United and Torquay United.

However, I want to deny that the government of Spain is thinking of taking people with a lisp to court when they say the 'pain' word; that would be bad taste!

In the case of Iceland, who is the naughty one - the company or the country? Both.

Do you think words and phrases should be legally copyrighted? Only in very limited circumstances. Yes a company should have a right to copyright their name but if they choose to name their company with the name of a country, person or place etc. then their rights should be severely limited and people or places should be allowed to use the part of the name that applies to their use without restriction. I don't think phrases should be allowed to be copyrighted. I don't think that obvious misuse or abuse of another's name should be allowed though.

Jaysus this is way beyond the bounds of commonsense. The name of the shop is surely a play on the fact that it mainly sells frozen food. SMH.

I don't think words and phrases should be copyright....it's different if you write a whole article and want to retain ownership but words and phrases...nope.

I hate to take sides against Iceland, but it seems to me that Iceland is in the right here.

I think that there is literally no thing that some uncreative and unprincipled son of a bitch will not attempt to monetize and reserve only to himself, especially if he was too much of a dud to create it himself. I have similar feelings about patenting genes, even if they were modified in a lab, with the possible exception of Levi Strauss.

A company or a country? .. I'd normally say that they are both naughty. .. But I keep hearing about how great Iceland is. Their fastest growing political party is a bunch of Pirates!

Iceland. .. .. Kind of a dull word for a country with the awesome word "Reykjavík" as the name of its capital.

I agree that a country owns it's name. But Iceland is also known as Island and Iceland shops have been trading for ages and no one has been confused. I do object to the company trademarking the Iceland word though!

I'm right with you on this. Copyrighting and trademarking words and phrases should only be given in exceptional circumstances. This is language we're talking about, invented well before capitlaism came on the scene!

I agree with you. The Icelandic government needs to relax and I'd take their position more seriously if they objected to Iceland shops when they started. Why now?!

The country Iceland as part of its legal defence is claiming that who people shop more at Iceland shops is when they promote Iceland as a tourist destination. I think it may be the reverse!

I think Iceland the country benefits from Iceland the company in this case. The country should have acted much earlier to protect its name, but given it didn't then so be it, no harm has been done on the country which strictly speaking is spelt Island!
