THE RIGHT TO HAVE SEX There are many international declarations asserting the right to have sex or, at least, the right to sexual expression - for example, the United Nations’ Universal Declaration of Human Rights (1948 ), the Council of Europe’s European Convention on Human Rights (1953), the United Nations’ International Covenant on Civil and Political Rights (1966), the United Nations’ International Covenant on Economic, Social and Cultural Rights (1966), and the World Congress of Sexology’s Declaration of Sexual Rights (1999). At a country level, many of us enjoy the right to have sex, with a few exceptions such as having sex with animals, and dead people. Most of us have few problems in enjoying these sexual freedoms. We just find a consenting partner to have sex with. But, for some people, these sexual rights don‘t mean much as they don’t have the capability to exercise such rights. Some severely disabled people are physically unable to have sex without help. There are many organisations around the world that help disabled people to have sex. These organisations provide sexual advice to disabled people; some organisations offer specialist sex equipment to disabled people; and other organisations arrange meet-and-greets so that disabled people can meet others. A few organisations provide sexual services to disabled people. For example, MyHandicap, based in Germany, provides services of professionally trained sexual assistants. Similarly, the TLC Trust, based in Britain, connects disabled people with approved sex workers. Recently I listened to a radio programme about disabled people’s sex lives. Many disabled people needed help from their assistants to have sex. Help ranged from being moved into various sex positions and assisting penetration. Most assistants stop short of having sex with those they care for; they don’t provide masturbation services. A few disabled persons said they paid for sex and used sex workers experienced with having sex with disabled people. But very few local authorities encouraged this and many local authorities banned sex workers from entering their care homes. Is this a denial of a disabled person’s sexual rights? Do you think there should be a statutory right to have sex? Do you think disabled people should use sex workers for sex? Do you think the state should provide sexual services to disabled people, eg employing sex assistants, providing specialist sex equipment, giving money to buy sex? The TLC Trust was established after a Sexual Freedom Coalition Conference in 2000 after James Palmer, a disabled man, revealed his sadness at being a virgin in his mid-40s. He then set up the TLC Trust’s website but was so busy promoting sex with other disabled people that he didn’t have the time to lose his virginity! He gave up running the website; I hope he’s no longer a virgin! |

Yes. rascalQUALITY pointed out that a right means equal opportunity and I think that's an appropriate way to look at a right to sex and sexual expression. In some third world countries like the United States there are still a great many citizens who think they should be able to dictate other people's sex habits and preferences, so we could benefit from a further clarification of rights here. The ninth amendment should theoretically address this issue, but some folks need further persuasion. Do you think disabled people should use sex workers for sex? Sure! I wonder if any sex workers take Food Stamps......? Do you think the state should provide sexual services to disabled people, eg employing sex assistants, providing specialist sex equipment, giving money to buy sex? That's a pretty big conceptual leap for a country that generally doesn't even recognize the right of able bodied citizens to purchase sexual services. Maybe we should start with baby steps. You gotta learn to crawl before you walk, and we aren't even crawling yet. So far we're just lying in the crib bitching about other people's sexual proclivities. Starting to blog, i got to be affriend with someone, pseudo 'wheelman" let's say. Nervous genetic disease, still a virgin in his 30's and everybody knew. Though he had female affriends, nothing seemed to happen for him, so i found a few phone numbers through the net in his nearbys ... professionals. He was too shy : it did not work. I lost traces since. I just wished then something official would exist ! A bit later, going in a libertine sauna, a young man with his frail GF in his arms wasn't admitted while we were waiting outside, a GF and I ... just unfair. I just wished it was possible to call the cops so they could step in. In France, my country, parliament rejected the idea of assisted sex for disabled. I feel it as a shame. States ought to help their citizens, right to sex included. In fact, over recognition of a social status for sexworkers as in Holland, I'd like indeed sexdough for more than disabled : poors, old people, why not ? I think everyone should be free to have sex if they wish.....and if they want to use a sex worker that's okay. I don't think Governments should get involved in specifically allocating money for sex.....not a good idea having them know about your personal lives. ~~Anais Nin~~

Intellectually disabled and people with Down's syndrome are often left out of this kind of argument, yet by the time they reach physical sexual maturity, many crave it but are not deemed mentally competent to consent to sex. If these people are denied the "right", then the "right" should be downgraded to a freedom. I don't think governments should be involving themselves in the sexl lives of the people any more than they would want the people being involved in their sex lives. If disabled people choose to spend their money paying for assisted sex with reputable sex workers, I see nothing wrong with that. They get horny and need relief, it's natural. As no doubt in Australia, here there's a big debate about the visibly disabled and the invisibly disabled. I'll argue that we're all disabled and it's a question of extent!

Code 57-21 subsection 69 (A) "Sexual contact" means any touching of an erogenous zone of another, including without limitation the thigh, genitals, buttock, pubic region, or, if the person is a female, a breast, for the purpose of sexually arousing or gratifying either person. ( "Sexual activity" means sexual conduct or sexual contact, or both... Do you think disabled people should use sex workers for sex? Other than in a care home setting, is it prohibited? Whatever a disable person uses their allotment on is their own business. If it were otherwise, how would you determine the amount of the allotment? What if the person doesn't wish to or cannot have sex? Do they get less? What if they are a very sexed up and horny? Do they receive more and who would make that determination? How do you propose they demonstrate their eligibility to receive such an allotment if there were one? Bye the way, these are not rhetorical questions. I expect a full answer! Sex once a week for disabled people in a state-funded care home seems reasonable! That's still less than the average so they can still see themselves as disabled! If disabled people are given sex tokens, those who are very horny can buy tokens from those who aren't so horny. Market rules!
